BMABA Membership Agreement – Legal Terms, Safeguarding Duties & Use of Services

At BMABA CIC (Company No. 10676965), we are committed to operating transparently, ethically, and with fairness at the heart of everything we do. To uphold this commitment—and to protect both our organisation and our members—we maintain clear and comprehensive terms covering membership, legal conditions, safeguarding, and acceptable use.

This document brings together our Terms of Membership, our Legal Policy, and our Terms of Use into one unified framework. These terms define your responsibilities as a member, club, instructor, or user of any of our services, and outline what you can expect from us in return.

For the avoidance of doubt, the terms “Us,” “We,” “Our,” “BMABA,” “BMABA CIC,” “British Martial Arts & Boxing Association,” or “The Association” all refer to BMABA CIC, a private limited company registered in England & Wales under company number 10676965. These references also include our instructors, clubs, students, affiliates, directors, secretaries, trustees, executives, committees, volunteers, and staff.

Likewise, any use of the terms “you,” “your,” “instructor,” or “member” shall be taken to include both you as an individual and, where relevant, your business, club, organisation, or any related persons or entities acting under your authority or registration.

By engaging with our organisation—whether by applying for membership, using our platforms or services, or accessing our resources—you agree to the terms set out in this document.

Any membership registration or renewal is subject to these terms, inclusive of the terms of membership. Please do ensure you've read this fully before proceeding.

TERMS OF MEMBERSHIP

Insurance Inclusive with Membership

Your BMABA CIC membership may include access to insurance under our group cover policy. It is essential that you understand this is not a typical retail insurance purchase and must be approached with due diligence and care.

Insurance purchased via membership is non-refundable once issued, as it is bound to the group cover agreement held between BMABA CIC and our insurer. You must therefore ensure that any insurance arranged via membership is suitable for your individual circumstances before completing your application or renewal.

We do not provide individual insurance advice or regulated financial services. While we can guide you toward policy documents, summary schedules, and terms of cover, the decision to proceed rests solely with you.

By submitting a membership application that includes insurance, you confirm that:

  • You have reviewed the relevant policy wording and documentation

  • You understand the scope, limitations, exclusions, and obligations of the cover

  • You accept that the membership (with or without insurance) is non-refundable once active

All information required to make an informed decision is available on our website at bmaba.org.uk/clubs and in our Member Handbook at handbook.bmaba.org.uk. If you have any questions, you should contact our office before completing your application.

Important Notes:

  • We are not the insurer. You will be covered under our group insurance policy as a registered instructor or club, but you are not purchasing a standalone insurance product in your own name.

  • You will be expected to comply fully with the terms and conditions of the insurance, including those outlined in the policy wording and the general terms of our association.

  • All data you provide must be accurate and truthful. Any material misrepresentation or omission may invalidate your cover and membership.

  • Once your cover is issued, no refunds can be issued.

  • You must be able to ensure you have not been declared bankrupt in the past five years, have no undisclosed criminal convictions, and have not had insurance elsewhere declined or withdrawn.

Claims Procedure

In the event of an incident or potential claim:

  • You must notify our office in writing within 48 hours

  • Do not admit liability under any circumstances

  • We will support you through the claims process where possible, but ultimate responsibility lies with you to provide required information and cooperation with the insurance claims handler directly.

As the policyholder, BMABA CIC may communicate with the insurer or claims handler on your behalf in the initial stages, but you may be required to liaise directly with the insurer or appointed adjusters thereafter.

Suitability Vetting and Cover Activation

We only declare instructors to the insurer for active cover once the Suitability Vetting status has been updated to anything other than "Pending Confirmation" or "Not Currently Teaching", and once required checks (such as DBS and First Aid) are evidenced.

If vetting information is not updated, or required documents are not provided within 28 days of joining, we will consider you as not actively teaching, and your insurance allocation will be withheld without compensation until full compliance is achieved. This ensures we maintain strict compliance with policy requirements.

Once insurance confirmation is issued, you should consult the relevant articles in the Member Handbook for full guidance on managing cover for instructors, students, and clubs. It is your responsibility to review this material immediately upon receipt of membership confirmation. Duty of Disclosure

All members, instructors, and affiliates of BMABA CIC have an ongoing duty to disclose all material facts that may affect the association’s ability to license, represent, certify, or affiliate with you. This duty applies both at the time of joining and throughout the entire period of your membership.

Material Facts and Changes in Circumstances

You must inform us:

  • When requested, or

  • If any circumstance changes that may reasonably affect our professional relationship with you.

Failure to make a full and honest disclosure may result in disciplinary action or immediate expulsion, as deemed appropriate by the association.

Examples of relevant disclosures include (but are not limited to):

  • Criminal convictions, cautions, or active investigations

  • Adverse media coverage or public allegations

  • Bankruptcy, financial sanctions, or previous insurance issues (such as cancellation or special terms being imposed)

  • Any issue likely to impair the effectiveness of group insurance cover

Ongoing Disclosure Requirements

You reaffirm your disclosure responsibilities:

  • At the point of joining or renewing membership

  • When accessing certain services (such as insurance, Club Colours, or leadership recognition)

  • When purchasing goods, courses, or accessing endorsements through the association

By doing so, you confirm that there has been no material change in your circumstances, and that there is nothing material to disclose that may affect your standing with BMABA CIC.

Examples of What Must Be Disclosed

The following list illustrates material facts that must be disclosed to the association:

  • More than one instance of a LADO investigation into professional conduct, safeguarding, or coaching practice

  • Termination of services by a school or educational setting due to complaints or safeguarding concerns

  • Removal or barring from martial arts associations, governing bodies, or trade bodies

  • A substantiated LADO investigation

  • Any police investigation involving bail conditions or resulting in conviction

  • Referrals to, or barring by, the Disclosure & Barring Service (DBS)

  • Allegations or concerns related to safeguarding, conduct, or abuse — regardless of outcome

  • Failure to disclose any of the above during initial registration or at any point during your membership

  • One or more complaints from parents, carers, or students regarding professional standards, behaviour, or instruction

This list applies to any and all past occurrences, not just current or on-going matters. This means, for example, a past LADO investigation remains part of the disclosure requirement.

Agreement to Follow Association Regulation & Regulatory Guidance

BMABA CIC is a professional trade body, not a government-appointed national governing body. Membership is entirely voluntary, and by choosing to join us, you acknowledge and accept that:

  • You are not under any obligation to affiliate with us

  • You voluntarily agree to comply with all association-issued regulations, standards, and compulsory requirements

This includes any official guidance, safeguarding expectations, instructor verification protocols, or other regulatory standards set by the association, including our right to retain data for up to 7 years if we believe it relevant under our regulatory, safeguarding or compliance frameworks.

Failure to comply with key regulatory requirements may result in disciplinary action or expulsion, at the discretion of BMABA CIC. Your continued membership is contingent on adhering to these standards at all times.

Safeguarding & DBS/PVG Checks

It is your personal and professional duty to ensure you are fit, safe, and legally entitled to teach your students.

If your teaching involves children, vulnerable adults, or any other person requiring safeguarding, you are solely responsible for:

  • Conducting appropriate due diligence

  • Holding valid and up-to-date DBS checks or PVG Checks, as appropriate.

  • Implementing appropriate safeguarding policies

  • Maintaining relevant qualifications and procedures

While BMABA CIC may publish safeguarding guidance, issue regulations, or impose certain minimum standards, this must never be interpreted as a substitute for your own legal responsibilities.

You must carry out your own risk assessments and compliance checks to ensure that you meet all safeguarding obligations applicable to your setting or student group.

If you are unsure at any stage, please contact our Safeguarding Officer or the BMABA office before delivering any instruction. Safeguarding failures—whether intentional or due to negligence—may result in immediate disciplinary action or expulsion.

Insurance Obligations

It is your responsibility to ensure that you are adequately and appropriately insured for all teaching activities, disciplines, and classes you deliver.

Purchasing or activating insurance through BMABA CIC—whether for instructors, students, or events—does not guarantee that all legal or professional requirements have been satisfied. You must assess:

  • The scope and limits of cover

  • Any exclusions, conditions, or endorsements

  • Whether the cover is sufficient for your specific teaching context

Responsibility for Policy Management

You are solely responsible for:

  • Ensuring your insurance remains active and valid

  • Renewing or updating your cover as required

  • Administering cover in line with the terms of your policy and membership

We reserve the right to refuse or withdraw insurance at any time, without prior justification, provided that written notice is issued (in any form).

Cover Activation Requirements

We may, at our discretion, withhold the allocation of insurance if you have not verified required information on your account—such as:

  • A valid DBS check

  • Up-to-date First Aid certification

In these cases, we will allocate a full term of cover (e.g. 12 months) once all criteria are met, but until then, we reserve the right to suspend or delay cover issuance in line with our duty to manage risk and comply with policy terms.

Please note: The issuance of confirmation documents does not guarantee that cover is active if your account is not fully verified - just that cover has been arranged subject to status. It is your duty to ensure all required compliance steps have been completed.

First Aid Obligations

All instructors are required to hold a valid and appropriate First Aid qualification before delivering any form of instruction under BMABA CIC membership.

It is your sole responsibility to ensure that you:

  • Meet all legal and professional obligations relating to first aid provision

  • Are adequately trained, qualified, and equipped to manage medical emergencies during classes or events

  • Maintain up-to-date certification throughout the duration of your teaching and membership

While BMABA CIC may provide general guidance or information regarding First Aid expectations, this should not be treated as formal advice. Our guidance is non-binding and must not be used as a substitute for your own legal or professional due diligence.

You must carefully assess your own readiness and suitability before conducting any instruction. Failure to do so may result in disciplinary action and may also affect your insurance coverage.

Our Right to Termination of Service or Endorsement

BMABA CIC is committed to providing exceptional services, licensing, features, and support to our members. However, we reserve the right to amend, suspend, or withdraw any part of our offering where required by external factors outside of our control or based on internal sustainability factors.

This may include, but is not limited to:

  • Changes in government policy, industry regulation, or legislation

  • Legal orders or restrictions that affect our ability to trade or offer membership services

  • Shifts in risk appetite, insurer criteria, or licensing requirements

  • Internal decisions based on sustainability, compliance, or strategic direction

In such circumstances, we are released from any liability or obligation for the withdrawal, limitation, or alteration of services, membership features, or licensing provisions—whether advertised or not. You agree that changes or discontinuations resulting from such factors will not be held against the association and that no refund shall be expected where services are retired or access is restricted as a result.

We will always do our utmost to communicate changes in advance, especially where products, services, or resources are being retired. These announcements are typically made via the Roadmap Community space within MyBMABA, which is our primary channel for platform updates and system-wide notices.

While every effort will be made to highlight key service changes more broadly—such as via email, news alerts, or notices within the member dashboard—it is your responsibility to regularly:

  • Check the Community space in MyBMABA for roadmap updates

  • Monitor our embedded web chat box, which also publishes important service news and changes

Where possible, we will offer practical alternatives or solutions to ease the impact of any changes, but this is done without obligation or liability.

Your Responsibilities as an Instructor With Us

BMABA CIC exists to support qualified instructors in building safe, professional, and well-governed martial arts instruction. However, we are not a training body and membership is open only to those already suitably qualified to teach.

Minimum Responsibilities

As an instructor affiliated with BMABA, you are personally responsible for ensuring that you:

  • Hold an up-to-date Enhanced DBS check or PVG Scheme enrolment (where relevant to your audience)

  • Are First Aid trained to a level appropriate for your activities

  • Hold appropriate insurance cover for all disciplines, venues, and student groups you instruct

  • Have a safeguarding policy in place to protect your students and uphold national standards

These requirements must be satisfied before joining, and maintained throughout your membership. We reserve the right to challenge any omission or failure in meeting these criteria, and will not tolerate the concealment of safeguarding, criminal, or risk-related information.

Discipline-Specific Responsibilities

As we represent over 150 styles and disciplines, BMABA CIC does not issue individualised guidance for each martial art. Therefore, you are responsible for ensuring that:

  • Any BMABA-issued guidance is assessed for relevance and suitability to your specific discipline and club

  • You implement any additional safeguarding, insurance, or operational measures required by your style or setting

We aim to provide broad support across styles, but you must evaluate and apply this support appropriately.

Accuracy of Information

All information submitted to us is accepted in good faith, but we reserve the right to:

  • Verify, challenge, or request further documentation relating to your qualifications, insurance, policies, or eligibility

  • Take disciplinary action if false, misleading, or incomplete information is submitted

Any documentation that results in the verification of a specific compliance or status must be maintained truthfully and accurately throughout your membership.

Registration Integrity

If you have previously been registered with BMABA through another instructor (e.g. as an assistant), and that instructor is still active:

  • You must not re-register independently without the written permission of your lead instructor

  • Doing so may result in suspension or termination of your account under our "first past the post" policy, which grants account control to the original registering instructor

Please speak to our team before attempting to set up a new account in these circumstances.

Advertised Services & Products

All services, features, benefits, licensing, and insurance included or promoted within BMABA CIC membership are advertised in good faith and based on information accurate at the time of publication.

We reserve the right to:

  • Change, revoke, or modify any product, service, membership feature, or benefit

  • Do so at our sole discretion, without notice or explanation, where reasonably required

This may include adjustments due to:

  • Strategic changes within the association

  • Insurer or third-party service updates

  • Technical or legal constraints

  • The retirement or replacement of legacy offerings

While we maintain this right, BMABA CIC will always strive to:

  • Communicate changes clearly and in advance wherever possible

  • Uphold service accuracy and transparency for all members and prospective applicants

  • Ensure the continuity of key services, or offer reasonable alternatives where changes are made

We are committed to delivering a reliable, professional service, but make no guarantee that any specific product, platform feature, or benefit will remain available for the full duration of your membership.

Creation of Publicly Searchable Information & Retained Central Records

As part of our commitment to raising standards and promoting safer martial arts instruction, BMABA CIC maintains publicly searchable records for all registered:

  • Instructors

  • Assistant instructors

  • Officials

  • Teaching staff or volunteers

  • Senior graded students (if the club opts to use our LSGR)

These public records may include (but are not limited to):

  • Full name

  • Age

  • Registration and renewal dates

  • Disciplines practiced

  • Verification status for key factors such as insurance, DBS, safeguarding, first aid, and qualifications

These records are created automatically as part of your membership and will be maintained and updated throughout the duration of your affiliation. By submitting an application or using any of our services, you explicitly agree to the creation and use of such records.

Post-Membership Data Handling

After your membership expires, we may continue to display a public-facing record indicating your previous affiliation, unless and until we choose to retire it. We also reserve the right to:

  • Remove public records at any time post-membership at our discretion

  • Retain a central record of your affiliation indefinitely

This central record, stored securely within our specialist CRM, supports:

  • Future account reactivation

  • Insurance and safeguarding audit trails

  • The fulfilment of our long-term compliance obligations

Data Retention Terms

In accordance with our Privacy, GDPR & Data Retention Policy, we retain only the minimum necessary information, including your:

  • Full name

  • Date of birth

  • Disciplines practiced

  • Membership history

  • Compliance and verification statuses (e.g. DBS, safeguarding, insurance)

These records may be retained indefinitely to support insurance integrity, safeguarding responsibilities, and regulatory compliance. While contact details may be erased on request, your core record will not be fully deleted and may remain securely archived beyond the duration of your membership.

Hosting, Websites, Domains & Tech Infrastructure

BMABA CIC provides a range of optional technology solutions to assist member clubs with their online presence. These may include:

  • Club websites

  • Web hosting

  • WordPress website setup and management

  • Club management software (e.g. MyBMABA Club Manager)

  • Domain name registration and management

  • Webmail services

  • Other digital tools and infrastructure

All such services are provided on an “as available” basis, without warranty, guarantee, or liability—whether express, implied, or otherwise.

Availability & Communication

While we will always endeavour to:

  • Communicate clearly regarding planned changes, outages, or retirements of any system,

  • Provide reasonable notice of service terminations or platform changes,

We cannot guarantee uninterrupted access or real-time notice. It is your responsibility to:

  • Plan for critical digital infrastructure needs

  • Request written confirmation in advance if you require assurances for any services, websites, domains, data, or email hosting deemed mission-critical to your club

Service Changes & Terminations

We reserve the right to:

  • Edit, suspend, modify, or permanently terminate any part of our digital infrastructure

  • Do so at our sole discretion based on commercial, technical, legal, or operational needs

Any such changes may apply without notice, although we will always act in good faith and with transparency where possible.

Ownership & Usage Rights

Any website, domain name, or digital infrastructure provided as part of a BMABA membership feature or benefit remains the property of BMABA CIC, and is made available to you only for the duration of your active membership.

If:

  • Your membership is terminated (either by you or BMABA CIC), or

  • Your membership level changes and no longer includes a specific digital service,

We reserve the right to:

  • Retain or dispose of related hosting, domain names, websites, or data at our discretion

  • Charge a reasonable fee for maintaining or transferring such assets

Transfers & Exit Charges

There is no automatic right of transfer for:

  • Domain names

  • Email hosting

  • Website hosting

  • ClubManager systems or any other technical infrastructure

BMABA CIC reserves the right to decline any transfer-out request for services we have set up, hosted, or funded as part of your membership.

If, at our discretion, we agree to a transfer, the following minimum fees apply:

  • £250.00 per WordPress instance

  • £30.00 per domain name

  • Additional charges as reasonably required for time, system administration, or third-party involvement

We do not offer assistance with migrations or data transfers. All such tasks must be undertaken independently, at your own time, cost, and risk, without liability or support from the association.

MyBMABA Access and Records

Access to the MyBMABA platform — including all associated tools, content, and services — is directly linked to your active membership status.

Upon expiry of your membership:

  • Your access to MyBMABA will be suspended immediately

  • All data within your account will be subject to permanent deletion after 90 days post expiry or suspension

  • Deletion may occur at any point within this window, and may take place sooner than 90 days

What Will Be Deleted

Once deleted, your MyBMABA account — including all content and activity within it — will be irretrievably erased. This includes, but is not limited to:

  • Messages and notifications

  • Community connections and activity

  • Shared and saved files

  • Forum posts and replies

  • Course progress, completions, and certifications

  • Order history and payment details

  • Any other stored or interactive content

This process is irreversible. Once your account is deleted, it cannot be recovered under any circumstances.

Central Membership Record

This deletion applies solely to your MyBMABA platform account. It does not affect your core membership record held within our central CRM. That record, which contains essential compliance and licensing information (e.g. name, DOB, DBS, safeguarding, insurance, grading), is retained in accordance with our Privacy, GDPR & Data Retention Policy.

Qualifications & Online Training

All training courses, qualifications, and awards issued or delivered by BMABA CIC are provided “as is”, without any express or implied warranty or guarantee.

While we strive to ensure all course content and referenced materials are accurate, factual, and professionally presented, we cannot guarantee:

  • The accuracy or completeness of content across all modules

  • The ongoing availability or suitability of third-party references

  • That any particular course or qualification will be deemed sufficient by third parties, insurers, employers, or governing bodies

BMABA CIC is therefore released from any liability arising from:

  • The use or interpretation of any training material

  • Any reliance placed on external resources or third-party links included within our training

  • The perceived suitability of any course or award in a specific context

Internal vs External Recognition

Unless explicitly stated otherwise, all BMABA courses and qualifications are issued as internal awards. While many are widely recognised within the martial arts sector, we cannot guarantee their acceptance by:

  • Employers

  • Venues or hirers

  • Licensing authorities

  • Insurers or regulatory bodies

If you require a qualification for a specific legal, contractual, or safeguarding obligation, it is your responsibility to confirm in advance whether a BMABA-issued award is acceptable.

Questions, Support & SLAs

BMABA CIC is committed to offering high-quality support to all members, clubs, and instructors. Our small team works hard to respond to questions, concerns, and queries as promptly as possible.

We offer contact across a variety of digital channels to ensure accessibility and convenience. However, due to the scale of our operations and the size of our team:

  • There is no guaranteed response time

  • Most enquiries must be managed digitally, via web chat, email, or support ticket

  • We do not offer routine telephone or in-person support

Many of our services, resources, and systems are designed to be self-managed and accessed exclusively online. As such, members should ensure they are able to access and navigate online platforms to receive full benefit from their membership.

We always aim to provide timely and helpful responses, but appreciate your understanding and patience where delays occur during busy periods or complex queries.

LADO, Safeguarding, Disciplinary and Expulsion

BMABA CIC considers the termination of membership and, where applicable, associated insurances, to be a last resort. However, we reserve the right to immediately terminate membership—with no refund or compensation—where there is a serious breach of our terms, particularly in relation to:

  • Professional conduct

  • Safeguarding concerns

  • Duty of disclosure failures

LADO Findings and Safeguarding Authority

For clarity, and as outlined in our safeguarding policy, the Local Authority Designated Officer (LADO) plays a pivotal role in safeguarding investigations. Where a LADO meeting or investigation substantiates an allegation, BMABA CIC:

  • Will treat the outcome as final and binding for the purposes of membership decisions

  • Will take necessary action including the suspension or termination of membership and insurance

  • Is obligated to act in line with the LADO’s guidance, even in the absence of a DBS or Police investigation

These actions are undertaken without liability, warranty, or refund.

By joining or renewing your membership, you agree to be bound by LADO outcomes where safeguarding risks are identified. This is a condition of membership and cannot be opted out of.

Disciplinary Policy & Further Guidance

Website & Membership Terms of Use

All BMABA CIC websites, platforms, and digital services are provided strictly “as is”, and we accept no liability whatsoever for:

  • Use of our websites or digital platforms

  • Interaction with any software, tools, downloads, content, services, or data

  • Any direct, indirect, incidental, or consequential loss resulting from the use of our services or content

All content provided across our sites — including articles, downloads, videos, forms, and guidance — is offered for informational purposes only. It does not constitute legal, professional, or technical advice, nor should it be treated as a substitute for your own due diligence or consultation with relevant professionals.

Copyright & Content Use

All content is the intellectual property of BMABA CIC and is protected by copyright law. Unless otherwise stated:

  • Content may not be copied, reproduced, or redistributed without permission

  • Third-party content or data is used with appropriate consent or under licence

You agree that:

  • All posts, articles, web pages, and digital media are used entirely at your own risk

  • We are not liable for any loss, misunderstanding, or impact arising from reliance on this material

  • Viewing or interacting with any part of our website (or affiliated sites) signifies your full acceptance of these terms

Accuracy & Updates

Content is provided in good faith and is believed to be accurate at the time of publication. However:

  • We make no guarantee that all content is complete, up to date, or free from errors

  • Whilst we will always endeavour to do so, we do not guarantee our ability to undertake to update all content immediately upon changes in law, policy, or services

We recommend regularly reviewing key documents and verifying critical information before making decisions based on BMABA guidance or website content.

Merchandise, Orders, Inclusive Equipment, Clothing and Associated

BMABA CIC will make every reasonable effort to ensure that all merchandise, uniforms, equipment, and associated products are:

  • Accurately described

  • Fit for purpose

  • Supplied in accordance with the expectations set at the point of order or promotion

However, by purchasing or receiving any such items, you agree to:

  • Exclude BMABA CIC from liability for any issues relating to the quality, fit, performance, or suitability of equipment or clothing supplied

  • Accept that we do not guarantee the availability of specific stock or sizes at any given time

Substitutions and Stock Limitations

If a particular item becomes unavailable due to stock limitations, we reserve the right to:

  • Provide the closest available alternative, or

  • Offer a full refund for the unavailable item

Where equipment or merchandise is included within a membership package or supplied as part of a promotional or optional add-on, we may substitute the item for a suitable alternative at our discretion.

You accept that substitutions may vary in brand, specification, or appearance and that no compensation is due where a reasonable alternative has been provided.

Right to Refuse Service and Membership

As a private organisation, BMABA CIC is under no legal or statutory obligation to provide membership, insurance, services, support, or endorsement to any individual or club. Participation in our services is entirely voluntary, and by choosing to engage with BMABA, you acknowledge that:

  • We reserve the right to refuse or withdraw service, membership, insurance, or any associated provision at any time, and

  • We are not required to provide justification or explanation for such decisions

Equally, you are under no obligation to join or remain affiliated with BMABA. You may choose not to register, renew, or use any service as you see fit.

Circumstances Where Refusal or Termination May Apply

We may decline to offer membership or insurance, refuse renewal, or terminate any part of your affiliation with BMABA CIC in situations including (but not limited to):

  • Rude, abusive, or threatening behaviour directed at BMABA staff, volunteers, or member clubs

  • Reasonable grounds to believe there is an increased risk of harm to the public or, in particular, to children or vulnerable persons

    • (See our Safeguarding Risk Guidance for further context)

  • Non-payment of fees, including missed or failed instalments, or unpaid invoices

  • Lack of communication on a matter deemed material to your membership, where no response is received to formal outreach (excluding marketing communications)

  • Behaviour that endangers or destabilises BMABA systems, services, or infrastructure, as determined by our executive team

  • Unreasonable demands or conduct that places excessive strain on BMABA staff, systems, or support services

    • "Unreasonable" will be assessed at the sole discretion of the association

We are committed to fair treatment and open communication but retain ultimate discretion over who we serve and under what terms. All decisions made under this clause are final and binding.

Refunds, Inception and Termination

BMABA CIC operates a clear and final policy regarding refunds, membership activation, and termination. Please ensure you understand the following terms before proceeding with any membership application or renewal.

Refund Eligibility (Before Activation)

If your application is:

  • Still pending verification, such as awaiting proof of grade or supporting documentation, and

  • Has not yet been activated or processed,

then any fees paid are fully refundable in the event of:

  • Your decision to cancel, or

  • A rejection by the association

Inception of Membership (Non-Refundable Point)

Once either of the following occurs:

A. You complete an automated signup, granting access to MyBMABA, or
B. Any membership documentation, insurance certificates, or digital access credentials are issued,

your membership is deemed active, and all fees become strictly non-refundable.

At this point, you will have access to:

  • Annualised membership certification

  • Instructor insurance (where applicable)

  • Member-exclusive tools, downloads, blogs, and CPD content via MyBMABA

  • Training records, student systems, and other digital features

This access constitutes full delivery of services, and no partial refunds or pro-rata terms apply.

Termination by Member

If you choose to terminate your membership at any time within your active membership year:

  • No refund will be offered, regardless of usage or reason

  • Membership is non-transferable to another party or club

  • If you have opted for monthly payments, any remaining balance for the term becomes immediately due in full

At Renewal

You are under no obligation to renew your membership. Renewal will occur only if you:

  • Submit a renewal order, or

  • Provide written instruction to our team

If no such action is taken, your membership will automatically lapse. No further fees will be charged, and you will no longer be bound by our terms of membership.

However, once lapsed:

  • You are no longer authorised to use BMABA branding, logos, certification, templates, software, or any other IP

  • Any downloaded or accessed materials must immediately cease to be used for any purpose

Continued use of BMABA intellectual property or branding after membership expiry is a breach of copyright and membership terms and may result in formal action.


Monthly Payments

BMABA CIC offers monthly payment options to make membership and associated cover more affordable and accessible, especially for grassroots clubs and instructors. However, it’s important to understand that this arrangement is not a finance product or credit agreement, and it is offered at our discretion and cost.

Nature of Monthly Payments

Monthly payments are designed to spread the cost of annual membership over 12 intervals to ease club cashflow. Although the total membership fee for monthly plans may be higher to offset processing and administrative costs, we continue to absorb:

  • Transaction and gateway fees

  • System infrastructure expenses

  • Staff time for managing account changes and follow-ups

  • The risk of non-payment by a small minority of clubs

This facility is provided as a goodwill gesture and is not a pay-as-you-go service.

Non-Cancellable Commitment

As clearly stated during signup and renewal:

  • Monthly payment plans are non-cancellable mid-term by the club or instructor

  • Your commitment is for the entire 12-month membership period, regardless of usage or changes in circumstance

  • Cancellation requests outside of exceptional circumstances will not be accepted, unless explicitly agreed by us in writing

Missed or Failed Payments

In the event of:

  • One or more missed payments, or

  • Repeated failed billing attempts,

your membership may be automatically suspended and then terminated. In such cases:

  • You will be considered to owe the full outstanding balance for the remainder of the 12-month term

  • We reserve the right to recover the unpaid amount through third-party collection agencies if deemed necessary

  • A late collection fee, termination fee or re-joining fee of up to 10% of the outstanding balance may be applied to cover our administrative costs

This is a contractual obligation agreed upon when selecting a monthly plan.

Future Restrictions After Default

If your membership is terminated due to default on a monthly plan:

  • You will not be permitted to re-join under a monthly payment arrangement again

  • To reinstate membership, you must:

    • Settle any outstanding balance in full

    • Pay any future membership or insurance fees in advance on an annual basis

This policy ensures fairness across our membership base and protects the association from ongoing losses associated with failed payment plans.

SAFEGUARDING

All clubs, instructors, assistants, volunteers and stakeholders are required to prioritise safeguarding as an intrinsic part of their practice. Accordingly, all interactions, renewals, registrations and use of BMABA in part or in full, in anyway, is contingent on our national safeguarding policy being followed fully.
