What is Employer’s Liability Insurance?

EL (Employer’s Liability) insurance will help you pay compensation if an employee is injured or becomes ill because of the work they do for you. You may not need EL insurance if you only employ a family member or someone who is based abroad. You can be fined £2,500 every day you are not properly insured. Having proper cover for your employees is a legal requirement.

Does my club need it?

We can’t make a determination as to whether or not your club specifically needs employer’s liability – that’s for each club to consider based on their own circumstances.

Individual Instructors

If you are self-employed and work entirely on your own, you most likely won’t need employers’ liability insurance.

Larger Clubs

You are only required by law to have employers’ liability insurance for people who you employ under a contract of service or apprenticeship. Whether or not you need employers’ liability insurance for someone who works for you depends on the terms of your contract with them.

Work Experience / Interns

You might not be aware of this but the wellbeing of any work experience students or interns working for you is your responsibility. That’s temporarily or otherwise. And that brings employers’ liability insurance into the picture. As an ’employer’ you’re viewed as being legally and morally responsible for the people you give direction to. That means if they’re injured or become ill while they’re with you and they think it’s your fault, you could be held liable. Worse still, they can sue you for damages.

Freelance / Self-Employed Instructors

You are likely to need employers liability insurance if you hire instructors to teach for you as ‘sub-contractors’, even if you only hire them on a short-term basis, and they assist you with just one class or lesson. However, you don’t need employers liability insurance if you only hire self-employed bona fide instructors. It is your responsibility to ensure this is clear.
